1. Information and education only
Everything in the Service, including screens, scores, rankings, reports, alerts, Think Tank replies and prediction-market odds, is general information for educational and research purposes. None of it is:
- investment, financial, tax, legal or accounting advice;
- a recommendation, offer or solicitation to buy, sell or hold any security, fund, crypto asset, contract or other investment;
- a statement that any investment or strategy is suitable for you;
- a promise or forecast of any result.
Words such as "directive", "suggested move", "action", "strategist", "advisor" or "committee" are names of features in the app. They do not mean that a licensed professional is advising you.
2. No professional or fiduciary relationship
the owner and operator of NAV Desk ("NAV Desk", "we", "us") is not registered as a broker-dealer or investment adviser and is not acting as one. Using the Service does not create an advisory, fiduciary, brokerage, agency or professional-client relationship between you and us. We do not consider your individual objectives, finances or needs.
3. No trading and no custody
NAV Desk does not execute transactions, cannot move money or place a transaction in your accounts at the TSP or any financial institution, and never holds your money or investments. You carry out every transaction yourself, elsewhere, under that institution's own terms.
4. Not affiliated with the TSP or the government
NAV Desk is an independent, privately operated tool. It is not affiliated with, sponsored by, approved by or endorsed by the Thrift Savings Plan, the Federal Retirement Thrift Investment Board, the Department of Defense, any other government body, or any fund company, brokerage, data provider or prediction market named in the Service. Official information about your TSP account is available only from the TSP.
5. AI-generated content
The Think Tank and other AI features produce text automatically. We do not review individual replies and do not guarantee that they are accurate, complete or current. You should not rely on AI output without checking it yourself.
6. Third-party data
Market data, news and prediction-market odds are supplied by third parties. We do not verify them and are not responsible for their accuracy, timeliness or availability, or for anything a third party does or fails to do.
7. Provided "as is"
To the fullest extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy and uninterrupted or error-free operation. We do not warrant that data will be correct or on time, that alerts will be delivered, or that the Service will meet your needs.
8. Limitation of liability
To the fullest extent the law allows:
- NAV Desk, its owners, staff, contractors and suppliers are not liable for any investment or trading loss, lost profit, missed gain, tax, fee or penalty arising from a decision you make or do not make, whether or not it was informed by the Service.
- They are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of data, goodwill or opportunity, however caused and under any legal theory, even if told such loss was possible.
- They are not liable for delays, outages, inaccurate or missing data, undelivered alerts, or the acts of third parties.
- Their total liability for all claims relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim arose, or US$100.
These limits apply to the extent permitted by law. Some places do not allow certain warranty exclusions or liability limits, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.
9. Your responsibility to us
To the extent the law allows, you agree to indemnify and hold harmless NAV Desk and its owners, staff and contractors from claims, losses and reasonable costs (including legal fees) brought by a third party and arising from your breach of the Terms of Use or User Agreement, your misuse of the Service, or your violation of a law or of someone else's rights.
10. Events outside our control
We are not responsible for failures or delays caused by things we cannot reasonably control, such as internet or power outages, failures of data providers or delivery services, cyberattacks, or government action.
